1. Description of Service

Ovuly is a personal cycle-tracking and wellness tool. The App allows you to log menstrual periods, symptoms, moods, and view cycle predictions based on your data.

2. Not Medical Advice

The App is not a medical device, diagnostic tool, or contraceptive method. All predictions, insights, phase estimates, and fertility-window indicators are statistical approximations based on the data you provide. They may be inaccurate and should never be relied upon for medical decisions, family planning, or as a substitute for professional healthcare.

You should always consult a qualified healthcare provider before making decisions about your health. We expressly disclaim any liability arising from reliance on information provided by the App.

3. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement.

4. Your Account & Data

All health and cycle data you enter is stored locally on your device. We do not operate user accounts, and we do not collect, transmit, or store your personal health data on any server. You are solely responsible for maintaining backups of your device.

5. Subscriptions & Payments

• The App offers auto-renewing subscription plans (weekly, monthly, and yearly) via Apple's App Store.
• Payment is charged to your Apple ID account at the confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You may manage or cancel your subscription at any time through your Apple ID settings.
• Free trial periods, if offered, convert to a paid subscription at the end of the trial unless canceled beforehand. The specific trial length and post-trial price are displayed before purchase.
• Refunds are handled by Apple in accordance with their refund policies.

6. Free Features

The App provides basic period logging at no cost. Ovuly Plus features require an active subscription. Free functionality will remain available regardless of subscription status.

7. Apple Health Integration

With your permission, the App may read and write select data types from Apple Health (for example, menstrual flow, heart rate variability, and wrist temperature). This data is accessed only on your device and is never transmitted to us or any third party. You may revoke Health access at any time in your device's Settings.

8. Intellectual Property

All content, design, code, and trademarks in the App are our property or licensed to us. You may not copy, modify, distribute, or reverse-engineer any part of the App.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or that predictions will be accurate. Cycle predictions are estimates only and vary in accuracy depending on individual physiology and the amount of data provided.

10. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, health outcomes, profits, or goodwill arising from your use of or inability to use the App.

Our total aggregate liability for any claim arising from use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms. Upon termination, your right to use the App ceases immediately. Locally stored data on your device remains yours.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted at this URL with a revised effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Austria, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Austria.
